Anthony Scrinis, of Port Melbourne, is claiming that last year’s Port Phillip Election process was “undemocratic.”

He is challenging last year’s election result, a move that could force a by- election in Sandridge Ward.

Mr Scrinis will appear at the Municipal Electoral Tribunal next week after preliminary hearings ruled Mr Scrinis could present his case to the tribunal.

Mr Scrinis is alleging breaches of the Electoral Act took place before the November 29 election in his ward.

Mr Scrinis alleges three candidates, including elected councillor Janet Bolitho, distributed electoral material to houses within the 400m of the Port Melbourne Town Hall while early voting was taking place.

Mr Scrinis said it was a breach of the Act. “It’s a ridiculous law…. (but) the law is the law,” said Mr Scrinis to the Port Phillip Leader.
