The Athens Court of First Instance on Thursday banned Nikos Kouris, 54, from using the surname of Mikis Theodorakis.

A request for security measures to be taken was made by Margarita Theodoraki, the daughter of the late legendary composer, and the matter will be brought to trial on 30 November.

Nikos Kouris had been using the Theodorakis surname in his personal and professional life in recent years, something which the Theodorakis family said they were unaware of.

The family had met with the man a number of times, mainly due to the creation of the internet radio station known as Mikis’s Radio, which was created exclusively to promote the work of Mikis Theodorakis.

The composer had given his permission for this and there had been a number of telephone contacts and correspondence.

Before his death, Mikis Theodorakis had expressed his satisfaction for the radio station and Mr Kouris states that he had been offered material consisting of 4,000 recordings from concerts from around the world.

Ms Theodorakis and her brother George Theodorakis both say they knew Mr Kouris, however, up until now had not indicated any concern.

The first negative reaction came on 2 September when Nikos Kouris took to Facebook, writing “Goodbye Father”.

George Theodorakis called this the “fraud of the century”.

“Nikos Theodorakis is not the son of Mikis. His father is called Kouris. Hence his name is Nikos Kouris and not Nikos Theodorakis. He has no relation to our family or our entire extended family,” he said, calling on the media to refrain from interviewing him.

Mr Kouris told the court that he is not making inheritance claims, but added that he is willing to undergo a DNA test to prove his relations with the Theodorakis family.

“I invite Margarita to study the song of the dead brother which Mikis had written. Secondly, to look in her home to find the manuscript which I left which proves I am not interested in his assets or fame. For me, wealth is that he trusted me with his work, that he gave me 4,000 songs which, with the help of my colleagues, I manage to double and am trying to present his work to the world. What I have been doing for the past 20 years as Nikos Theodorakis, I did with his acceptance. He had accepted it, and he never doubted me. I will move to the next step and prove this with a DNA test. I adopted the name Theodorakis because I wanted to get closer to my roots,” he said.
