The assault charge against West Tiger NRL player Benji Marshall has been dismissed by a Sydney court today.
Magistrate Carolyn Barkell said that she could not find beyond reasonable doubt the injury sustained by the accused was caused by Marshall, rather than a second man involved in the assault.
Marshall faced the media outside the court and said “it gives me a good chance now to just concentrate on finishing the season” and that he was “very pleased with the outcome”.
The accused 25-year-old Soliman Naimey said that 26-year-old Marshall punched him outside a McDonald’s restaurant in Sydney’s CBD in the early hours of March 5. Marshall admitted to pushing the Naimey after he racially abused him but denied the punching him.
