Legal action by Greek Australian student activist Drew Pavlou suing China’s senior diplomat in Brisbane was dismissed in a Queensland court on Monday.
Mr Pavlou took action against the Chinese Consul General Xu Jie for allegedly inciting violence against him in breach of Queensland’s Peace and Good Behaviour Act, but the Queensland court dismissed this complaint. The legal action concerned a statement reportedly posted on the consul-general website condemning a demonstration organised by Mr Pavlou at the University of Queensland and referring to anti-China separatist activities. The statement has since been taken down.
Brisbane magistrate Janelle Brassington dismissed the application after ruling that Dr Xu has diplomatic immunity as he was functioning as a consular officer.

Following the dismissal of the case, Mr Pavlou took to Twitter stating he “won’t give up”.
A fundraiser has been set up and has already raised more than $15,000 of a $25,000 target target to be used to establish a non-profit organisation, called the Defend Democracy Alliance, to fight human rights abuses across the world. “This will allow Drew to continue his great humanitarian work and take it to a new level,” say the organisers of the fundraiser.
